§ 1 General provisions

These Terms of Use (the “Terms”) govern the use of the website operated by
Bytamic GmbH (the “Provider”). They are issued in accordance with the
Austrian E-Commerce Act (E-Commerce-Gesetz, ECG) and other applicable Austrian and EU law, and
set out the type and scope of services provided via the website, the conditions for using it,
the conditions for concluding and terminating the contract for use, and the procedure for
complaints and contact.

§ 2 Definitions

  • Provider — Bytamic GmbH, with its registered seat in
    Vienna, Austria (Albertgasse 35, 1080 Wien), registered in the Austrian Commercial Register
    (Firmenbuch) under FN 558907y at the Handelsgericht Wien, VAT-ID (UID-Nummer)
    ATU77125558.
  • User — any person who uses the website or the services made available on it.
  • Website — the documents made available at
    https://www.bytamic.com, including graphics and related elements.
  • Services — the services provided by electronic means via the website,
    within the meaning of § 3 ECG (Dienst der Informationsgesellschaft).

§ 3 Type and scope of services

The Provider makes the following available electronically via the website:

  • information about the company and its services (software engineering and digital platforms,
    AI & automation, support as a service, and IT consulting);
  • success stories and case studies;
  • insights, including downloadable reports and publications (PDF) and curated AI news/articles;
  • careers information and job listings, with the option to apply for a position or submit an open
    application by uploading a CV;
  • a contact form for partnership, project, consulting and support enquiries.

The Provider also operates separate, affiliated services under their own terms and privacy notices,
in particular bytamic.ai (AI & automation) and support.bytamic.com (support portal). These Terms
apply to https://www.bytamic.com; the affiliated sites are governed by their own conditions.

§ 4 Technical requirements

To use the website you need internet access and a current web browser supporting HTML5, with
cookies and JavaScript enabled, and access to email.

§ 5 Use, conclusion and termination of the contract

  1. Use of the website is subject to these Terms.
  2. The contract for the electronic service is concluded when the User starts using the website.
  3. The User must not provide unlawful content or take actions liable to disrupt or damage the
    website. Where the Provider receives confirmed notice of the unlawful nature of stored data,
    it may disable access to that data; the Provider’s liability as an intermediary service
    provider is governed by §§ 13–19 ECG.
  4. The User may stop using the website at any time, whereupon the contract terminates automatically.
  5. Information on cookies and on the processing of personal data is set out in the Privacy Policy
    (Datenschutzerklärung).
  6. The Provider is not liable for interruptions caused by faults or malfunctions of IT systems
    beyond its control.

§ 6 Specific risks of electronic services

In accordance with § 5 ECG, the Provider notes that using internet services carries the risks
typical of the public internet (e.g. malware, hacking). Users are advised to run up-to-date
anti-virus software and a firewall. The Provider maintains reasonable safeguards against
unauthorised access to its systems.

§ 7 Complaints and contact

Users may raise complaints regarding the services by email to
office@bytamic.com or in writing to the registered seat stated in § 2.
A complaint should describe the issue, the date/time it occurred, and the User’s contact
details. The Provider will respond without undue delay. Statutory consumer rights and time limits
under Austrian/EU law remain unaffected and are not shortened by these Terms.

§ 8 Final provisions

  1. Use of the website requires acceptance of these Terms.
  2. The Provider may block access to all or part of the website for good cause, in particular in
    case of misuse or risk of harm.
  3. The Provider may change the website’s content and technical parameters and may
    temporarily or permanently limit or withdraw the service, with notice posted on the website.
  4. Matters not regulated here are governed by Austrian law, including the ECG and the General
    Civil Code (ABGB). Mandatory consumer-protection provisions (e.g. KSchG, FAGG) remain unaffected.
  5. The content of the website (text, graphics, trademarks, logos, software, etc.) is protected
    by copyright and other intellectual-property rights and may not be reproduced or distributed
    without prior consent. Use is permitted only within the limits of permissible own use.
  6. These Terms are made available free of charge on the website in a form that allows them to be
    retrieved, reproduced and stored.
